Sure they can. They got my 60$ for the game, but the way things look right now it does'nt seem they'll get a single penny more from me...

Don't forget that they have greenlit Bioware doing clarification and closure DLC. In other words it akin to polishing the turd on that cushion. Its not going to make things look better, Its not what the fans want, its going to be messy.
