the problem is that when i turn 3D acceleration off the whole game is flickering like mad and completely unplayable...
and when i turn it on the game is playable but crashes every 5 to 30 minutes which is getting pretty annoying...
does anyone have an idea whats causing this? i know its a really old game and im running windows 7 (64bit) but there has to be a solution
i have a problem with my game and the 3D acceleration :(

I can't really help much with questions like this, as I am no tech expert, but, off the top of my head, have you tried the following:
-install Easy Tutu or BGT. I have never had any trouble running the game on either XP or Windows 7.
-make sure you have the official patches installed.
-try right-clicking on your game icon and selecting properties. There, select "run in compatability mode". Then try different ones. I think most people get good results with compatability modes "Windows XP service pack 2" and "Windows XP service pack 3".
-also under properties, try clicking "run as administrator".
-try updating your graphics card drivers
-you can download the GoG.com version of the game and avoid all this stress altogether. It costs less than $10.
-if none of this works and nobody else can help you, you could wait for BGEE, which is supposed to be released this summer.

That picture is a rendering issue i.e. likely to be caused by hardware... are you using a very old machine, maybe a notebook or tablet?

yes i've tried it all and my game is installed in a folder i made just for the game

Try bringing up your config.exe and fiddle with the settings. There is an application located in your game folder by that name, or I think it's "bgconfig.exe" or something like that.
It's not the same as your options screen, and you open it from inside your game folder, without the game running.
At the end of messing with the settings, you should get a screen with red, green and blue colored squares inside each other, for five seconds, and then a dialogue box saying "did you see the concentric squares?" That's how the game tests your graphics settings.
