Why won't this useless thread just die already, six days for a story that has no impact on anything is way too much. It should have been buried 2 days ago.

Actually it did die, until someone brought it back to life.

Bioware and EA were either legally acceptable “puffing –” i.e., a standard level of exaggeration engaged in by any salesman, or done in an interview setting that couldn’t be classified as true advertising.
FTC>bbb
Just saying.

Actually,  no they weren't.
Puffing "Drinking pepsi will make 80 year olds feel like they're 20!"
False Advertising (Insert BBB's quotes here)
False Advertising "You can achieve the best ending in SP without touching MP,  there's more than enough War Assets!"
Puffing is exaggeration,  what EA did was falsely describe the contents of their product.

Hey bro that's a federal trades commission quote.. I take federal over private aka bbb

Laws can change with the times.  You could pay reviewers to falsely bump up review scores in 2008 without disclosing anything.  Now under the new FTC regulations you have to disclose you are a paid reviewer.  I looked everywhere looking for a case that stated that interviews can't be counted as advertising and got nothing. Where did you get your information that things don't count in an interview setting?

Advertising Review

BBB has nothing to report concerning Bioware Corp's advertising at this time.

nobody checks facts here

Or they can't read....

That post says:   We have tiny number of complaints against Bioware and, since they don't pay us to evaluate them and they don't answer our emails, we fail them.    Oh, and just to make sure that they fail, we'll pretend that they are a corner store for our ratio calculations.   Since they don't pay us to figure out how big they actually are.

Seriously?

Who cares. Most of us here were going to buy ME3 on day one before it was even announced. They made a couple of empty promises regarding the last 5 minutes of the entire game. So what?

If you guys think this is bad, you should check out the Fable franchise. Peter Molyneux has made hundreds of promises that were never fulfilled prior to the release of each Fable installment. Yet he hasn't been sued.

I would like to point out that while the FTC can actually do something about false advertising, the FTC still advocates using the BBB.  Here is one example:

The extent to which an ad represents a pattern of deception, rather than an individual dispute between a consumer and a business or a dispute between two competitors. State or local consumer protection agencies or private groups such as the Better Business Bureau (BBB) often are in a better position to resolve disputes involving local businesses or local advertising. To get the address and phone number of your state Attorney General's office, your local consumer agency, or the nearest BBB, check your telephone directory.

The BBB is a helpful organization, but its amazing how many people fail to realize its a private pay for ratings organization, just like a credit agency such as Moody's. Its actually less official than the credit rating companies, because those companies' ratings actually affect contractual mechanisms. The BBB is more like Consumer Reports, except they charge businesses instead of sell magazines.

The BBB is a group one pays to give you a shiny sticker for your window. It is not any kind of regulatory or governmental agency. It uses the money businesses pay for those shiny stickers to provide all kinds of useful consumer protection information.

Thinking "something will come of this" in any legal sense is to fundamentally misunderstand what the BBB is.

According to VGC, estimated ME3 sales for Xbox (the largest platform) in the United States (the largest market) has dropped below ME2 sales for the last three weeks even with all the discounting at retailers like Amazon, Best Buy, Walmart, Ebay, etc.

I doubt the EA heads are ROFLing hard about that.

Probably not ROFLing about their stock making new lows for the year or being voted worst company in America. Or losing money for the last six years in a row.

The ME3 situation has nothing to do with two of those three.  It may have contributed to the third, though.  But only through a coincidence of timing.

And the fact that all the people BoA screwed over are homeless and too poor to have internet anymore, unlike the ME3 folks.  ;)

Sure, other companies could've won the prestigious 2012 Poo award, but apparently it was not their time. Maybe next year.

The point is the EA heads aren't ROFLing hard when you add perspective to the situation. Heh, they are probably not even ROFLing hard when they look at their sales and consider all the additional production costs like delayed release date, adding multiplayer, increased inflation, increased advertising, etc.

I'm sorry, it's impossible to take that award seriously in a world that includes Halliburton, Bank of America, and Xfinity. I mean, is the ending to a video game somehow worse than THIS?
http://techcrunch.co...5/comcast-know/

No. It's not. It's simply a virtue of timing and internet rage and cannot, in any way, actually be taken seriously in a world that includes actually flat out EVIL companies.

Bank of America primarily has clients in America and, if any at all, very few overseas clients (if I am not mistaken). I am not familiar with Halliburton so I cannot say anything about them, but it is possible that more people felt screwed over by the ending than were negatively affected by Xfinity. Of course, "possible" does not mean "probable". It is highly probable, however, that people that were going to vote for EA because weren't just doing it because of the ending (I'm sure some have, though), but were likely going to wind up voting for EA anyway. It obviously also is likely that many who voted for EA also have not had anything bad involving those other companies happen to them, so they have no reason to vote for those companies.

I agree there are more worthy companies, but they didn't win this year. This year EA got the honor of being the worst company in America.

Hey, maybe some good can come from it. You've seen the video from the EA CEO where he details how to milk invested customers through micro-transactions. EA is now talking about adding in-game adversting. This is on top of day-one DLC and their propriety game client. People are upset with EA.

So, given the fact EA did win the worst company in America award, maybe they can take this opportunity to address the complaints against them.

We all know their stock could benefit from some good decisions right now.

I think EA is far beyond the point of no return. In-game advertising isn't such a bad idea, though; that is, if it sticks to little things like you're playing Grand Theft Auto and you walk by a Coca-Cola or Pepsi vending machine. Just little things that make common appearances. But if I were playing, say, Assassin's Creed and Ezio is being chased by guards and suddenly turns around with a can of pepsi, does an advertising one-liner pitch, chugs it, and then you go back to playing then that would kinda tick me off Image IPB

Over an ending no.  Of course it's not worse than that.  But it's not like EA has become hated all of a sudden, it's been hated for years now.  It spearheaded the online pass system which is threatening the used and rental game industries (I realise it's not the only company but it was the first to aggressively use it), it's monopoly over the Madden series, buying up companies burning them out and trashing them, and closing off servers nearly a year after a game is released.

I don't know how much the work environment changed after the EA spouse fiasco.  Although deadlines seem just as harsh as ever.

I mean EA has been bad for awhile now and has played a big role in changing the industry into a worse place for consumers.  I will concede that Capcom overall likes to gouge its customers in a harsher way.

Edit: And was there any truth to the claim that EA hires people to troll the forums and divert attention from problems?

I wanted to stay away from the forums as much as I could for now(to avoid spoilers), but when I saw this I just had to come back.

I mean if you're banning ppl simply for voicing their distaste for the ending or whatever, then I'm pretty dissapointed in you Bioware. :/

EDIT: Serious question, should I remove that first banner? :S

Come on. One guy says he got banned for doing nothing more than liking the ending, and someone makes a story of it? If that were true, there'd be TONS more bans handed down. People like kbct and thunderhawk would be banned simply for voicing their opinions. And to the best of my knowledge, they haven't been. You get banned for launching personal attacks or using tons of foul language.

Plenty of people on both sides manage to disagree without getting banned. This is just another smear campaign against BioWare by someone who broke the rules, but doesn't want to acknowledge it was his problem he got banned, not BioWare's.

Talk to L00p, it has happened to him. And no, i did look and he broke no real rules, and he got banned by one of the mods for no apparent reason...

I've seen l00P make all kinds of personal attacks on posters he doesn't like in many discussion threads. If he was banned, it was for that reason. Also, I'd like to thank you for posting an example, right there, of the kind of thing that will get you banned.

Yeah I've gotten in heated debates and haven't been banned yet.  That being said the Mods probably get sick of everything and ban people on both sides as a warning.  Some bans seem a little excessive but that's probably because we've gotten accustomed to periods where the banhammer hasn't struck when it should.

I got banned a couple days ago for literally no reason. When it was up, I PMed every mod asking why I was banned because I did not do anything that I knew of that would have justified a ban and that I would prefer being notified of the reason so, if I did anything intentionally or unintentionally, that I could remedy it. Every single one of them said, in short, "I don't know, wasn't me. I'll ask around".

Honestly, if I was a mod, I would have banned a lot more people - including myself - just as a warning to everyone to keep it more civil. Disagreements get heated, heated conversations lead to things being said, things being said leads to MORE things being said, and soon you have chaos.
