Whether it is worthy of the title "GOTY" will depend greatly on what they do with the EC. Personally, I don't have much confidence that BioWare will do anything substantial with the EC, but I would love to be wrong.

This. I imagine most critics would just overlook that, but between that and the backlash from the end, it probably doesn't stand much chance anymore. I suppose it depends on how well its competition does and the DLC, but I still think it lost the chance at GOTY when they messed up the choices in addition to the ending.

my money is on gta 5 if the october 2012 release is true because man that game will outsellf ac3 imo
i want me3 to win but i do agree certain things need to be corrected to fix alot of things

Those are more of personal preferences and do not make a game good or bad.
for example, Uncharted 2 has most of these features you listed above, but it's still one of the best games in recent years.

The awful Journal and face import bug alone throw mud in the face of that claim... let alone all the other awful design decisions (linearity, lack of dialogue choices, autodialogue, purely cosmetic choices that don't really matter, everything is about combat, etc.).

Uncharted 2 isn't supposed to be an RPG with player choice a major factor, and it never claimed to be; it's an action-adventure title. Uncharted 2 also doesn't stray from the formula set by its direct predecessor, and in fact builds on it.
ME3's main weaknesses stem not so much from being a bad game, but a bad Mass Effect. Almost all the things that Mass Effect was supposed to be about was thrown down the toilet with ME3. Yes, the combat was finally perfect... but that's not what Mass Effect is supposed to be and not what I came to it for. If I want to play great TPS combat, I'll go to a pure TPS game like Gears or Space Marine. I wanted an immersive sci-fi roleplaying experience that felt personal, which ME1 was, and even ME2 brought for the most part. ME3 failed in every single area that it should have excelled at and excelled at the stuff that didn't really matter.

I don't want to talk about quality here, Skyrim has problems too, but Skyrim was praised by reviewers AND customers. There are still many games coming this year, and I'm sure some of them beats ME3. I haven't followed how things went with Diablo 3, I was betting it to be Goty of this year, but what little I heard it was disappointment for some people. But, so was Skyrim too, no way everyone can be happy with something.
if we use popularity to decide game of the year, then Call of Duty should win GotY every year, no Competition.

I'll admit it I probably would've said yes. But you know what?
I would've been wrong. That just goes to show in some ways how easy Bioware has it and how with just writing a half way decent ending I and most other fans would've forgiven them almost anything. So now they are getting called out on everything that was wrong outside of the ending as well. Boo fricking hoo. Thing is even now if Bioware really knuckled down and produced a superb EC with 16~ different endings that don't rely on space magic and showed all the variables etc... I and I bet many other would still overlook all the things wrong with ME3.
We might rage but ultimately the majority of us are an easily pacified and forgving lot. It's up to Bioware now really.
