D3 is addictive, replayable + fun gameplay. GOTY so far.

It's true what you say BUT, Blizzard just did what they did in D2. They are no major innovations in D3, that's not enough for a GOTY title.
It's good, but not hyper super amazing awesome. That's what I expect from a GOTY.

I personally think GotY will be Halo 4 or Assassin's Creed 3. Pretty much everything I've seen from those two games is completely positive, both developers are clearly putting alot of effort into them, and their respective fans are extremely hyped.

A typical shooter have like 1/4 of the content. SP alone is easily over 40+ hours without rushing. There is also sufficient differences between the classes, as well as minor differences between femshep, male shep, as well as renegade & paragon, to warrant at least another run or two.
And FFXIII took like 5 or so years, & the game offer almost no choices, with little replay value, super linear with dull combat mixed with CG heavy cut scene.
I have not played D3, purely as my PC cannot support the game, & I am home bound for the last 2 weeks (broke my ankle), & not able to buy a PC to play Diablo 3. I reserve my judgement until I played Diablo, but so far ME3 is GOTY worthy, & the EC & future DLC could be the deciding factors if it can win GOTY.

There are no major innovations in most games these days, and the most innovative games rarely win. Besides, ME 3 can't compete on those grounds, either, unless we count the ending controversy as innovation
Trying to think of a Game of the Year winner that really deserves it on innovation grounds. Fallout 3 won didn't it? I'm sure Oblivion did, too, but neither provided massive innovations; they were just a further development on Bethesda's house style (Oblivion especially; Fallout was at least adapting their house style to a new setting).
Honestly, both games are in the running. If I were asked to pick I'd go with Diablo, though, because it's a cleaner package with fewer flaws (mainly referring to the horrific journal and side quest system of ME 3).

The gameplay, story, graphics and finishing polish of the game is what gets games GOTY.
ME3 fails on at least 2 of those.

I think ME3 was too ambitious an undertaking to finish developing in 2 years. An RPG trilogy with thousands of different decisions to take into account is an overwhelming task, and I certainly felt that depth was sacrificed in the name of speed. Certain key elements of 1 and 2 were overlooked or under-developed (Collector Base, Rachni Queen, Dark Energy, Harbinger, ME2 squadmates, etc.) and the side quests combined with the broken journal felt more like fetch quests than in the previous installments.
Given its context, I expected ME3 to be the most immersive and gripping of the 3, but it wasn't. Combat was vastly improved, the locations were superb, and there were some truly great moments (the whole Genophage quest for one), but because I often felt that the game was trying to cram so much into so little and resorted to auto-dialogue quite a bit, it felt more superficial and passive than 1 or 2.
Finally, I cannot overlook the ending, which felt like a slap in the face. I felt directed and manipulated by a deus ex machina, and the lack of any closure or clarity was appalling. I'm all for making a difficult choice at the end, and to me, all 3 choices had an element that was profoundly repulsive. But to top it off by killing Shepard no matter what (if you play SP only), disconnect the universe through the destruction of the relays, leave you blind to the fate of the vast majority of squadmates and strand fleets away from their home and those closest to you on some unreachable Eden World was just overkill.
Even though BioWare is by far my favorite developer, they made some crucial errors in judgment with ME3 that would be validated by a GOTY win and that I fear would compromise the quality of their future games. So no, for the first time, I wouldn't vote for them.

and honestly, Skyrim was a broken and bug-riddled game that won GOTY by numerous publications, so anything is possible.

None of the bugs in skyrim were game-breaking, and most were fixed within a few months. The glitches never blinded me from all of the awesomness in skyrim, the game was too good to ignore.
I cast my vote for halo 4. Halo has always been the greatest game series ever.
