Having tried the D3 beta, it's a better looking D2.
That makes it good; maybe even great, but probably not GOTY. I mean, it's not May. Let's see what else is out there.

It very well may end up being the most remembered game of the year for it's polarizing ending and the varying discussions it caused ranging from journalistic integrity, entitlement, and the medium as a whole.
In terms of who will based on quality, I'm prone to think Bioshock Infinite is a serious contender. I don't believe that DLC, free or not (at that point is it a patch? I guess that would be fixing something they don't see as broken.), should be factored into things like GotY.

No. There's plenty that's still rough, and the gameplay is almost entirely evolutionary (ME to ME2 felt new; ME2 to ME3 feels simply improved).
It might win for content or overall presentation, but I don't think it's going to be the "best" game this year when award season comes around (according to whoever it is that judges these things).
These awards are pointless and stupid, though, so it really doesn't matter.
