TOS's hold up about as well as tissue paper does to stones when up against real laws. It doesn't matter what they put in their policy, if it breaks the law it breaks the law.

I think EU offers the only possible out maybe, its worrded very weirdly and given the laws are very openly worded they could find a way out but in the US we seem to be too stupid to notice that our right to due process has been revoked by EA in favor of arbitration. These are the TOS agreements that we are forced(not requested) to sign in order to play any game that we purchase for 60 bucks and we aren't even told the TOS before hand. I'm still waiting for some one to try and challenge this TOS further. there have been some court cases where certain states require EA to state the TOS before games are sold but it never went far enough. I would like to see this agreement brought before the supreme court since it is very much relevant in preventing due process for the customers but not for them, read it very carefully it shows that EA can sue their customers or anyone they deem fit for a lawsuit by their legal team for various reason but the customers are required to go through arbitration, I think in my state it goes against fair agreement or something like that because if I remember correctly a contract cannot be one sided and this is
its like giving a car dealer the money before you sign the paperwork station that you will be happy with whatever they sell you, mark my words the rest of the US economy will follow this example if its not stopped here.
