It is an obligation. And it is for legal reasons.
There is no law that says they must ban modders. So there is no legal obligation in that sense.
However, by not taking action against any mod that is against their listed ToS they open themselves up to the probability of any judge saying "Well, you didn't seem too interested in protecting your IP in case 'X', why should I hear case 'Y'?"
It has happened before, and it will again.
If IP rights holders don't protect their IP and enforce their ToS 100% of the time, they end up with no legal leg to stand on when cases of real infringement crop up.
If they pick and choose and allow special exceptions to their ToS, they end up in a very difficult position should they ever need to involve a court in a dispute over ToS violations or IP protection.

The Platinum Difficulty I'm working on allows there to be 5 Banshee's on the map at the same time. They also have incresed barrier/armor pools.

If it isn't possible Bioware needs to look into adding that to the game's infrastructure to make it possible. We've already had reduced/increased enemy types before for Brutes. Bioware just needs a way to have multiple such "specialized" files the game could pick from.
I salute you guys for being willing to risk EA's wrath over game mods, frankly ya'll should be given honory mention when this kind of setup gets add. Because it should and needs to done.

You can change the amount of waves to whatever you want. But that means you'll have to create new waves (12, 13 etc) under SFXGame.

Is there way to spawn Swarmers (the little tiny bugs the Ravagers drop). If so those could add environmental irritation without need to just spam more husks. The residual acid blood patches and DoT could make things that much harder.

Maybe when you guys add in the boss enemies, it won't be AS easy to blow through with the above builds... I'm looking forward to seeing a Banshee with 20x the damage-taking capabilities. XD
