This is thing is not black and white. Bans of first time offenders is overkill (and probably not legitimate).

How do you know this is the first time they did it? or are you assuming they are being truthful?

I have to agree. While i in no way condone cheating in any form, i am not
convinced the punishment fits the crime. If real world money was spent on MS points
and DLC that money should be immediately refunded. I think just resetting the
account to N7 0 - with all newbie characters AND a 15-30 days suspension
would be more than enough. In fact if that happened to most people they would
just break the dvds and never play Bioware games again.

 

Consumers do have rights.

innocent until proven guilty. Why would you accept Bw opinion over that of Ruben? Think about it for a sec. why? Its just people there too. I am not judging anything and in contrast to you I am not assuming anything either. I do not know ruben, but why would my vantage point be tht he is lying? i live in central europe and work in construction but even that can' t be an excuse to have that as a starting point. II don't know who is right, I am just saying that all aspects need to be considered.

I agree that if local law permits it, they should persue that avenue and try and get a refund. That is really the only right I can see them having that would be recognized by law. Take it to judge judy Posted Image

I think you derserve it. I am sorry but I have a feeling you just never thought they would ban you if you didn't host. One time I was in a gamer with hackers and I am still trying to figure out how to help ban them. I should still have all their PSN's written down.

An absolute possibility. I don’t believe the "6 Mil in one game" story at
all. I think he said it happened in one game to solicit empathy. I am sure it’s
more accurate to say he credit glitched with his friends 150 times for 6M buying
packs then entire way to get weapons.

 

I still believe a permanent ban is extreme. Resetting the
account and warning the next offense will result in permanent ban would make a
lot more sense.

what a terrible comparison. getaway drivers are fully aware of their part in the crime, this person, however, didn't appear to be. and he even said he contacted bioware about it after it happened, and got nothing. if anything, he reported finding money to the cops, and got no response.


of course, he could be lying, and wanting pity for some reason.

Like I tell my kid you didn't "find" anything, when he "found" an iPod. Ruben if you spent those found credits your guilty and get over it. You should have made a scene in the forums or EA support. I see a lot of these comparisons. It's not the same. It can't be compared to those type of real life situations. No one is in any real danger here.

This isn't about guilt  , it's about punishment. Ruben was not punished for hacking, he was punished for spending credits he did not earn legitimatly.

There is a case for arguing the severity of the sanction, but ruben himself admitted his guilt. it's not an issue here.
 
I also think the punishment is a bit harsh "IF" Ruben is being truthful.

Was he to play the game and not spend any money until it was resolved? Was he supposed to stop playing until it was resolved? Isn't that effectively banning himself? If BW expected him to somehow deal with the ill gotten gains in a responsible manner then they need to tell him what that means exactly.


It's pretty simple, if you are not totally demented.

"I have 6 million credits from that hacked game that I'm not supposed to use. I buy with just the money from legitimate games, but as soon as I hit 6 million, or slightly before that, I stop buying any more packs. 6 million credits is the new 0 credits for me."

Why not? Still a minor role in the offense, still gets the same punishment as the guy with the gun, so to speak. By spending 6 million credits that he KNEW he shouldn't have had, he became an accomplice to the cheat, and deserves the punishment he got.

And if he's let off the hook, then it sets precidence for anyone to claim that they "didn't know" and also be let off.

It can when you are only concerned with the motivations. In this case it does not fit though.

Because Ruben is guilty of nothing until he spent the first credit, whereas the robber and driver were guilty the moment they conspired to rob the bank.

He should not be let off the hook though, I may not agree with the severity of the punishment, but I don't have enough details to determine if it was warrented. So i accept that bioware made the right decision, and if they didn't I would hope the appeals process will flesh it out.
