Shepard was never tried. It was a summary hearing and a slap on the wrist in comparison to the 'crime'. The Alliance needed to show that Shepard was being punished, but they had no intention of actually punishing Shepard because the Alliance actually believed Shepard about the Reapers. If Shepard had been tried, Shepard would have gotten a lot more than a discharge and house arrest. Execution would have been on the table.

Again though, we never saw it and again that hearing could be used to properly explain what's going on before the Reapers came to town, properly introduce and explain just who James Vega is, and could be used to recap import players or character build new players a la Genesis, but with the actual game engine instead of low quality comic panels.

It should have been in the game. And if they were worried about not grabbing the attention of new players, add in a training section (i.e. Shepard doing fitness tests) or allow the trial to be skippable in Action Mode.
But for all the long term fans, we wanted that trial. We wanted to defend ourselves, and to have consquences to our actions. And we didn't. Heck, all that happened was the Admirals looked confused and asked a Lieutenant Commander for strategic advice. Erm, okay?

I voted no. Not because I didn't want the trial but because it'd be awkward if inserted now and I'd rather have DLC that focuses on other things. As it stands, the current intro is totally fubar and reeks of upper level management.

Why not? The Genesis DLC was introduced way after ME2's release for character building, so why not Shep's trial DLC? Could be used as a prologue to the current opening and would be fully skippable (I know it's not a word) for import players.

If Bioware does do it I just hope that they don't repeat the mistakes that were made with Genesis. (i.e. bad writing, awful comic panels, missing plot points, etc)

While I loved the intro, this is a great idea. Maybe have renegade/paragon options that are greyed out no matter what, or only accessible if you had a high para/ren on the previous games?

There was a trial in one of the leaked scripts, but apparently it was removed at some point.
My guess is that it didn´t make it because bioware wanted to "jump right into the action" for new players that may get bored watching/playing a cinematic of 10 or more minutes.
I think the whole cinematic from the holding cell to the alliance war-room was redone in order to make it faster to get into the action.

Yeah, that was the impression I got too. Still, it was a missed a opportunity to properly establish characters, setting, back-story, and Shep's stance on the looming threat that everyone seemingly wants to idiotically ignore. That, and for new players would be a great dramatic way for character building before the Reaper's assault on Earth.

I was really hoping/wanting to defend all my actions and desicions just like Jack Bauer in 24. Sadly like many other dissapointments it was removed from the game for no reason.

There is still hope in the form of DLC being added later on. We'll just have to wait and see after the EC hits. At the very least it should be on the table. The abruptness of the time skip without the context of knowing just what in the world in going on without additional input from an import file or character building makes things disjointed and incoherent. Plus, how they introduced Vega was also too abrupt and and of place. We have no context on who this man is and why we should care and not everyone is had the convenience of reading the comics. Heck, I know some people who didn't even know there were comics, but even then it was ill-suited. A Shep trial DLC would be perfect to fix these problems.
