EA doesn't have anything to do with Rock Band now. Maybe say they are too busy selling Battlefield servers or something.

The DLC isn't out yet and the patch is supposed to be out now, twice now the game froze on me before loading the main menu, my guess is the patch is somhow responsible.

For those judging time based on when XBLA normally updates that isn't really related. EA will determine when the content goes live, for example Harley Quinn's Revenge, DLC for Arkham City, came out today as well but that is already available.
