"Bait-and-switch is a form of fraud, most commonly used in retail sales but also applicable to other contexts. First, customers are "baited" by advertising for a product or service at a low price; second, the customers discover that the advertised good is not available and are "switched" to a costlier product"

They advertised a free dlc pack that included 2 maps, 6 characters, 3 weapons, new gear items, 1 game mode. What we got was 2 maps and 1 game mode with the chance to unlock 6 new characters, 3 new weapons, and gear items with money or in-game currency. Free characters/weapons/gear are the bait, spectre packs are the switch.

Here is your money for the DLC back... $0
Now stop playing it

Good luck in your pursuit.

Free products and services do not qualify as bait and switch, as you were not defrauded any money, especially when your claim over the switch is so tenuous.
What would you be suing for? The 3 minutes it took to download? The cost of the bamdwidth for said download? You were not harmed or defrauded anything. You have no case.

So I'm guessing the OP spent real money to try and get these items and it didn't work, so now he says he wants to sue EA.

What happens when he pays for lawyer fees and then that doesn't work out, will he sue the lawyers?

Will the same happen to the lawyer he uses to sue those lawyers? Is this like, which came first, the chicken or the egg? Immovable object and irresistable force?

if your not trolling your an idiot.
fraud: deceit, trickery, sharp practice, or breach of confidence, perpetrated for profit or to gain some unfair or dishonest advantage.
no profit or advantage obtained. no monies exchanged therefore no fraud.
pack contents as advertised - no deceit or breach of confidence.
go smonke something, chill the f out or gtfo

No they didn't. The cost to the customer is included in the online pass.

I'm sure a judge or lawyer would just agree to get them out of their office than throw out this "case"

That's brilliant! Let's form a class action lawsuit. We all paid $0.00 for the DLC, so if hundreds of thousands of us ban together we'll get a total of $0.00. Once the lawyers take 40% of that $0.00, that leaves $0.00. So, a completely equitable split between all parties results in a distribution of....$0.00.

In any lawsuit, you must prove that you lost something (i.e. lost money).  Because this DLC was completely free to download, you incurred no loss, and then any purchasing of spectre packs would be clearly made by your own understanding of the store system, so you couldn't prove you were tricked.  I suppose you could try to argue that you lost time which you could have been earning money in the five minutes it took you to download and run the expansion, but I'm pretty sure any attorney would just laugh at you.

I would love to see this make it to court just so the case can be ripped to shreds.

Go ahead and try it. Please. Please.

I would pay to watch how quickly that got thrown out and you were jailed for contempt of court just for trying it.

You know, I've lost a lot of faith in BioWare with ME3 (and gained some, too [Tuchanka storyline was amazing]), but I'm giving them more than enough chances to make up for it and I'm not going to call them names or take legal action over petty things like this.

I can honestly say I'm losing even more faith in the fans. Some people on these forums...

Yes. It's paid dlc. Not free. Op needs to get these details right to be taken seriously.

It's you, you know.

It's players like you that are endemic as one of the "starbucks" generation, demanding instant gratification while shunning real effort. And hey, if someone gives you a product for free, then giving you a choice of whether you decide to work for the prize or simply leave it be... I guess it's only rational to start thinking about a lawsuit against the right SOB's that are being so horrendously unfair to your mental well-being that they request that you put some work in order to enjoy the free product they put time and money into.

It's you and people like you that feed fuel to the "entitled gamers are the real jerks" argument that cropped up sometime after the ending controversy

And hey. With posts like the OP, hell, even I couldn't blame them. You make me sick.
