you know. it's not just the ending that made ME3 bad. There's lots of other reasons ME3 fell so short as GOTY worthy.

No way in hell would I call ME3 game of anything.
Even if you ignore the terrible ending (with or without EC) it's still just not that good. It doesn't measure up to ME1 or 2 by any stretch of the imagination, and it's kind of an insult to the whole damn franchise.

If your primary criteria is a game that is inovative and advances the medium as an art form then there are better options out there than ME3 in this regard. In terms of inovation ME3 didn't bring anything to the table that wasn't there with ME2 back in 2010.
Of the games I've played that were released this year I'd say a more interesting choice would be "The walking Dead" released by Telltale Games. It is a hybrid adventure/RPG game. There are some action elements and some puzzle-solving elements as well as a lot of interactive dialogue. What has impressed me about the game is that most of the decisions are on a timer (usually a rather quick one) so you are generally forced to make a quick "gut" decision rather than sitting back and pondering the potential ramifications of each option. I haven't seen this mechanic used much in this type of game before and I have never seen it implemented as well as it is in this game.
In many cases the repurcussions of a decision aren't immediately clear but what you do see immediately is a change in the way the various NPC's react to you. I often found myself conflicted over who to support and have seen my perception of some of the NPC's change drastically. On subsequent playthrough of the first 2 episodes (5 are planned, only 2 released so far) I have found that making different choices can have provide a rather different experience. The story itself doesn't change (as of yet) but the mood certainly does as everyone treats you differently. This is a good thing as it adds a lot of replay value. It's certainly a nice change of pace from all of the auto-dialogue in ME3.
To summarize, ME3 was a decent game and relatively well polished (still feels half finished to me) but didn't really push any boundaries as far as innovation. "The Walking Dead" by Telltale isn't nearly as polished (relatively primitive graphics, controls can be a bit glitchy at times) but is innovative and makes use of a decision making mechanic rarely seen and rarely well implemented (and does a damn good job of it). If your main criteria for picking a "Game of the Year" is innovation then "The Walking Dead" is a better choice than ME3 since it actually did try to be innovative.

And please, stop using the "oh it's just a weak year for games" excuse. Every year there are maybe 3-5 games that realistically have a chance of being named GOTY. I'll give three for this year: ME3, Diablo 3, Batman Arkham City. ME3 is far and away better than those other two games.

DIablo 3 is just a shoot and loot game, and those don't win very often. On the other hand, AC3 is taking some huge chances by time warping into the revolutionary war. i can seethat going really, really wrong.
