You're arguing an absurd extreme of absolutes, an impossible standard considering the medium of a pre-programmed game. OK, could you explain to me how Thane and Legion being able to survive would deny advancement of the plot in same way?
Legion is showing you that he is willing to sacrifice himself so that his species can evolve.
Thane's death either leaves you an emotional wreck, touches you deeply as you recite his last rites, or you just shrug your shoulders because it means nothing to you. In any case if he is alive at the time you meet Kai Leng, he steps in to fight him so that another can live. Again a message to the player, that has an effect on them if they so let it.
Personally, I would argue that without those deaths the game would have a lot less meaning to me. They helped plot out my Shepard's ending decision.

It's not fking hard honestly. When you (BioWare) throw around Artistic Integrity every 10 seconds as to the reason WHY you didn't change your ending, and only EXTENDED it with Clarity and Closure (I had a smirk writing that as even the "Clarity and Closure" is laughable), you CLEARLY had a Vision as to what the Ending were going to be and what effect they would have.
You even went as far to show us slides of what happens to the world after the decision was made, and WENT FURTHER and gave A Big middle finger to a decent portion of your fanbase by adding Refuse ... Yet you can't just man up and say, "IT is true/false".
Personally I don't believe in it anymore and will permanently stay away from all future BioWare products ... But you've got a portion of the fanbase who still believe in IT, and when all the DLC's come out and there's no IT in any of it, you will lose them as customers anyway, so may as well break their Hopes now and get it over and done with :S
I hope you don't take pre-picked questions at Comic-Con.. And I hope you get fking ripped apart by some fans, you deserve it. It will be the last time I'll ever have anything to do with BioWare again, I hope I get to at least watch you Squirm before I say goodbye, you deserve it over and over.

Game devs have a responsibility to there fans. Most people do... NOT... like the endings(however most people are only ok with it).
I wanted to be more then "ok" with a great series end and was not givin that. It would have been great with an indoctrination attempt on shep as it would have made it an emotional impact on us. I always thought that my Shep would at some point come face to face with an indoctrination attempt and the fact that he did not kind of brakes the game.

2. Skyrim AKA Better than ME3 Nr 1. :Skyrim didn't spend much time on my hardrive. I had like no motivation to do anything and like leveling up 8 levels at once and spending all of it on combat skills apparently made me a weaker fighter. Honestly I enjoyed Diablo 2 or Dark Forces 2 far more. Oh and Even Pre-EC Mass Effect 3. And SInce I can interpret KAsumi's sidequest anyway...
3. Witcher 2 AKA Better thna ME3 Nr 2.: People tend to pull witcher 2 out of their asses when they want to cite a game which takes decisions very seriously. News flash: It begins with disregarding all and every decisions you made in Witcher 1. Romanced Shani? Sorry. Saved Ada? Sorry. And so on. ME3 did an excerllent job with using seemingly unimportant ME1 sidequests(Conrad).

The game would have NOT ended with a cliffhanger had the IT been true. A new DLC could then finish the game and give a new meaning to the word "immersion" in the way that we play games by actually indoctrinating the player throught by taking to heart the catalyst's logic.
