The "best" tool is 3DS max, but it is an expensive commercial product. There are some free programs available, like gmax (basically a stripped-down version of 3DS Max 4), XSI modtool and Blender, all of which have been extensively used by modders in the past.

Of course, some people have to be different, and use Cinema 4D, Silo, Maya, Milkshape or even Google SketchUp.

Basically, you just need a 3D modeling program that can export to a format which can be converted to the DA model format.

However - a word of advice. Don't attempt to start by making a model from scratch. Start by taking some of the existing DA models and modifying them. Then start making static (non-skinned/animated) models, and finally move into skinned/animated models - they are really not suitable for someone whi is just starting.

Models are made in a 3D modelling program like 3DS Max, Maya, XSI, Lightwave, Blender, etc. For animated models, such as NPCs and creatures, you also have to create a rig (bones) and weight the mesh/skin to allow the animations to deform it appropriately.

To make a griffon like you mentioned would take a lot of experience in both organic modelling and rigging/animation. Years worth most likely. It's not the sort of thing you pick up in an afternoon.

Tzpan has a tool to convert fbx files to the right format, I have a script for 3dsmax and gmax which will export straight to the DA format.
