Every piece of fan art and fan fiction is a potential copyright violation, but the only person who can decide if it's a violation or not is the copyright holder.

If I draw a picture of Morrigan, BioWare has every right to sue me for doing so. Most entertainment companies choose not to do so because it's costly, time-consuming, and often angers the fan base.

When it comes to copyright, what's illegal is whatever the holder decides they won't allow. (Other than things like parody or other types of fair use.)

You don't understand the fact they they did not create the universe, plot, characters, and story line mean make anything based on it to sell is wrong.

 

It would be like making a selling spiderman comics with out any notice to company that owns the rights.

When it comes to copyright, what's illegal is whatever the holder decides they won't allow. (Other than things like parody or other types of fair use.)

And if it is something that is making money its diffently without a doubt going to be looked into and gone after in most cases. Copyright laws in the U.S and Canada are pretty solid and you are right from my understanding of things.

I'd say there's law and there's common sense.

It depends on what you do .

Law is great , but people still need to use their brains to apply it properly.

Wow, I've actually reached the end of the thread, so far. I have wanted to post a number of times but always been too far behind, I didn't think it would make sense to talk about something from 20 something pages earlier :). So while I have the chance I would like to thank Hrungr, Ladysif and those others of you who keep the rest of us fed on juicy tidbits of information, tiding us over until the game's release, and to all the devs who take the time to tweet and bring a bit of fun into our lives, reading this thread is the highlight of my day.

I realise this post is technically off topic as its not really talking about a tweet, so sorry about that, I shall now return to my lurking state.

I actually work for a company that does licensing for a few major companies, and there's a HUGE difference between selling artwork, and selling commission. 

 

Both are illegal, but one is more likely to get prosecuted.

 

If someone pays you $20 to draw a picture of unique picture of Morrigan just for them, no one will care.

 

But if you draw a picture of Morrigan, and start selling prints at $20 a pop, they will come down on you like a ton of bricks.

 

It also depends on the company. Some IP holders will crack down on a single $5 sketch, others will ignore you unless you starting making thousands. But GENERALLY speaking, as long as the art is unique and commissioned (even when based on an IP), you're unlikely to get in any trouble.

 

That's how most Etsy sellers get away with it, by the way. They do extremely small volume of extremely cheap products that are not likely to be mistaken for "official", with largely one-of-a-kind pieces.

No they can't. Parallel likeness is cover by copy right law. No can't just change the name and use the same plot and characters for a paid product.

But what if someone commissioned to an artist a picture of Dragon Age, can Bioware sue the artist for making money of their franchise ? Or would they not since the artist was paid for drawing whatever his client requested ?

They could still sue. Legally speaking, people are not allowed to use characters from the series as they are someone's property. That said, I don't think they crack down too hard unless people start making a noticeable amount of money.

Copyright law is kind of a double-edged sword. Either you protect your IP like a tiger and risk pissing off the fans, or you're too lax about it and the fans start making money on YOUR creations. It really sucks for artists really, because the best way to get a following is by making fanart and then gradually and very sneakily introduce your new audience to your own stuff!

 

Anyway, on topic. I'm hoping for Jennifer Hale to be the voice of a particularly salty bar wench. Mark Meer could be her tired-of-life husband and bar owner who'd rather drink his ale than sell it. I'm a sucker for snarky couple's banter  :rolleyes:
