Hey CZ, I copped out and got a wireless reciever for my Xbox and a 3month gold membership for XBoxlive, I got almost all the DLC for free except for Kasumi, the Appearance Pack, and one other thing. Also sending an Adept through ME to import to ME2.

Is Kasumi worth the cash?

Damn you, Top of the Page!!!!!!!
Ok since I am on a Mass Effect 2 Kick:

Non sequitur thing of the day.

I've lost my ability to gurgle mouthwash, I only choke on it.

And I want to know if Kasumi is worth it too.

Well, I gag and start coughing at the same time. So I say choke.

It's weird, I was able to do it before.

Zarro & Charsen: Looks like the Bioware elves woke up

It's not really an answer, is it?  There are two parts quoted, one referring to 'objectionable' content, and one referring to intellectual property rights.   It doesn't say which one applied in this case, which is what the thread was about.

I think the answer is clear. The first clause they give just shows they have the right to remove material at their sole discretion. Don't get confused by the word "objectionable" - it's only a cover-all term that is commonly used in ToS. The crunch is in the IP clause. For some reason, someone took exception to the BBC material being posted and either reported it or took direct action. Bioware cannot say the action was taken for a breach of copyright because the only people who can claim that copyright has been infringed are the actual copyright owners. They can remove images that they see violating IP, at their discretion, and this is what they are saying. Perhaps, if the BBC logo hadn't been on it, this might not have happened. This is a really tricky area of law though so they are not likely to give any more explanation than they have.

I've been on several forums as a poster and as a moderator where material was removed for copyright reasons and that explicitly stated. Deleting stuff for fear of copyright infringement and then not saying this is why is silly, because then people won't know whether or not it's safe to post similar material.

I've no idea why CZ was singled out for that one image, but a toad definately rightclickreported because, well, they're a toad.

If it were a matter of copyright, having the BBC logo splashed across it should make copyright violation *less* likely.

But they did explain!

Under Section 5: Contributing Third Party Content to EA Services
You may not upload or post any Content on EA Services that is protected by copyright, trademark or other intellectual property rights unless (i) you are the owner of all of those rights; or (ii) you have the prior written consent of the owner(s) of those rights to make such use of that Content. EA may, without prior notice to you and in its sole judgment, remove Content that may infringe the intellectual property rights of a third party. If you are a repeat infringer of EA's or a third party's intellectual property rights, EA may terminate your Account without notice to you.

In simplier wording - nobody here can post anything covered by intellectual property rights unless it's their own work, or they have first got written permission from the IP holder. Otherwise, EA will use its own judgment and take whatever action it needs to do to protect the company from legal risks.

If they had included that in the email there wouldn't have been an issue. EA is just too damned lazy - I bet they have only one form email they send for all alleged breaches of ToS.

Umm... no. With the logo on it the image made it obvious it not only infringed on BBC copyright but also on its trademark. BBC is VERY aggressive about taking legal action over that kind of thing.

Basically, a copyright violation occurs whenever someone uses intellectual property that belongs to someone else, without the owners permission. The risk of consequences increases when the IP belongs to a worldwide, multi-zillion dollar corporation that gets pissed real easy. ^_^ If someone wanted to spend a lot of money looking at every post on these boards they'd find loads of potential violations. CZ was just unfortunate that someone noticed.

Assuming EA are smart enough to do that ;)
It's the only thing that makes sense though. If whoever did it was getting in a knot over m/m affection then loads of us would have got notices. **** - even the game should be getting one!

I do not believe that the post was reported because of intellectual property reasons. I do believe it is very likely that many of our posts here get reported, and that is a shame. I do believe that there are many more lurkers here than posters, by a huge amount (as is common on internet groups). My point? I don't know that I have one. But my guess is it's two men kissing in an affectionate (rather than overtly sexual) way is what caused the problem with the moderator.

Whatever. I'm really disturbed by the whole thing. Even if the "official" reason is copyright infringement, and there is NO indication that it is the reason, I think the motivation for both the reporting of the post and the warning is bigotry.

if it was a copyright notice, then FAR FAR more people would get notices because the vast majority of images posted on this forum are copyright protected.

so by your own logic, you just proved it can't be copyright.
