it wasn't copyright. I'm not going to discuss it further, because at this point it's just insulting.
I'm not being a devils advocate here at all. I am trying to say that in a public forum people who understand IP issues know not to write anything that could cause problems for themselves later. When sending an email out about ToS violations I have to take pretty much the same approach EA did, most likely for the same reasons. People prefer not to be sued, and have to take care that they don't put anything in writing that could harm their companies if they face legal action. IP infringements are
huge risks these days.
The problem I see here is that the content of that image makes it easy to assume that it was a m/m kiss that resulted in the notice. It might have been, if one individual was left to make a decision about what he/she thinks is appropriate. I'm inclined to think it was the BBC logo that caused the problem. Stanley quoting the IP clause reinforced that for me.
If its easier to think that EA have got it in for m/m or f/f action than to consider that having an identifiable copyright & trademark violation on the forums that could see them in court would be an issue for EA, then feel free. The fact that they are not going after everyone here tells me that it was that image, with that logo, that was the problem, not the subject matter of the image.
I'm not trying to defend EA/Bioware either. I think they handled this very badly & need to review their processes and the email they send out. I don't think we will get answers on the forum.
