If they just wanted to create a set of armor inspired by Mass Effect, yes they could just use one of their own people. They wouldn't be able to use the specific designs created by the artist whose work OP linked to this thread unless they were willing to pay. It would be highly unusual to base in-game items of fanart, no matter how good it is.
At any rate, I was merely responding to your comment about plagiarism, not making statements about standard practices at BioWare.
