You'd be wrong on the first count. If I heard a guy say what Stardusk said in person, though, there's a strong, strong, strong chance it wouldn't end well, which is strange, since he isn't wrong. It trivializes the issue far more than jokes do.

That's due to America's bull **** culture. Then again, many things about american culture is bull ****. I wonder how long before the law catches up with the fact that this happens.

It's in many countries. The UK is just as bad as the US:
