I would have to say yes on that one.
Killing someone is not a minor thing, even if she does it a lot. And she should be accountable for the good and bad it causes. Because even though she's upholding her code of justice by punishing a criminal, she's wronging people who committed no crime but loving the person that she killed.
Not to mention the hypocritical side.
By her own code, she should kill Shepard after the whole Arrival deal -- An entire star system destroyed and 400,000 innocent civilians dead. If she didn't make some small allowance, then she would have attacked Shepard on sight in ME3.

Keep in Mind that Samara often search out dangerous criminals and majority of those dangerous criminals are killers and psychopaths.
Even by her code and her nature, she would understand that Shepard had no choice. One of the allowance of Justicar Code is that if there is no way to save innocents to stop a greater threat, it is excusable.
There was no way in hell, that Shepard could have saved them.
