After 2 and the first half of 3 I don't think anyone can make a rational argument that any Shepard "cheated" on Ash or Kaiden.
No Shepard could be reasonably expected to believe that a relationship still existed.
That was the opinion I got as well, even if my cannon Shepard was holding out hope of patching things up with Kaidan it still always seemed pretty much like a deal breaker to me.
