First it's not contract law, it's Copyright law, and while you are purchasing the license to use the IP without breaching Copyright by purchasing the game, the disc simply being the physical means of conveying the IP, owners are subject to Fair usage rights within common law.
Fair usage lets the end user dispose of the license and IP, without being bound to the EULA or license, so long as it is not financially detrimental to the IP holder and I'm not passing the IP of as my own. In effect, while I do not own the IP, and have bought the license to use it, that license can be sold and traded from user to user without binding the first user to a contract with the IP holder.
Which is why the Xbox system can go screw itself. It is, at the moment DRM by proxy.
The game is bound to the ID as well as the xbox, so if my brother and I want to play the same game, we can only do so on my profile, no seperate accounts, if he wants to play on his profile it implies that it would be a second hand game and the pay wall pops up.
If it was not on the same xbox, it would only work on my ID, which a friend would access, even if I sold him the game and the license along with it, remember fair usage rights, he could still not access it. In flaggrant breach of fair usage rights.
And if I wanted to lend him the license, then It looks like I can't use my profile because he's using it as the license is tied to my ID, ipso facto I can't play games if another person has borrowed a game and needs to use my ID to play on it.
In effect, Microsoft system bad and crappy, don't buy. And I'll stop with the legal techno babble
