Wow

No. No. No. **** no. Just...no.

If customers of the Xbox One have the same exact issues with the same circumstances, they should be allowed to use class action against Microsoft. Thay just seems more reasonable. Having to sue individually? All that does is benefit Microsoft and keep them from fixing recurrent issues for their console.

You can only shoot yourself in the foot so many times before there's no more foot to shoot.

I know it's not all that uncommon for companies to have the "you can't use a class action lawsuit against us" thing.

A quick check shows that Valve uses it, and everybody seems to love them.

It really wouldn't surprise me if Sony was using it as well.

Meh, Steam isn't known for selling broken stuff though.

WoodysGamertag over in his latest video brought up a good point- bundles.

PS4 is $399.
X1 is $499.

If you're the kind of person that cares about games and not really much else, what if the PS4 comes with no games but the X1 launches with a bundle of two or three?

Thats a better deal, at least as an opener, strictly game-wise.

I take it you weren't there for launch.

Either way, the point is that it's stupid that the internet is going to rage about MS doing this when other companies that they praise are doing the exact same thing and they didn't even know about it. It's not like we need to go out of our way to find reasons to criticize Microsoft right now.

If people actually read the terms and services of the products they used, these things would rarely be news =P

Yeah, that is true. Xbox does like to bundle, at least in comparison to Sony. Sony does have a next-gen Move, but unlike the Xbox it seems that there isn't any bundling options with it. Though, the situation is different since the Kinect is mandatory.

Either way, I'm sure there will be bundle deals eventually. I don't think it would be the best move to buy a console on launch. A good three months or so will really give you a good perspective on the pros and cons of each console. Who knows, the Xb1 just might have more to offer than the PS4. We certainly won't know within the first week though.

But yeah, I was just joking around with the class-action thing. It's not too uncommon of a thing, and companies need a safety net as consumers get more and more angry. Microsoft is trying to make a console for the digital age. I can respect and understand the move, it just may not be right for me.

I don't like Steam. Or their client, I should say. But Valve would have to spend the next 5 years digging themselves into a hole to get to Microsoft's level right now.

I'll take a PS4 with 0 games.

I wouldn't hook up the One if I got it free with 10 games. 360, I'm still considering. But most likely used, without policy changes.

Is that really legally enforceable? Who says a group of people can't file a class action lawsuit just because of your stupid EULA?

Not so much. There are plenty of hardcore Halo fanboys who won't let some corporate totalitarian measures of enjoying Halo in the privacy of their own home whilst the spycam collects data on user habits.

"You are in control of when Kinect sensing is On, Off or Paused: If you don’t want the Kinect sensor on while playing games or enjoying your entertainment, you can pause Kinect. To turn off your Xbox One, just say “Xbox Off.” When the system is off, it’s only listening for the single voice command -- “Xbox On,” and you can even turn that feature off too. Some apps and games may require Kinect functionality to operate, so you’ll need to turn it back on for these experiences."

It's about whether you want the Kinect sensor on or off; it's about being required to have it when you don't want it.

The law mainly. The fine print tells you what you agree to, buyer beware.

That reddit thread doesn't clear up the kinect listening (apparently) when it is already off.

This is exactly what Microsoft doesn't get.
