It terms of games at least, this is fine print you don't necessarily agree to prior to purchasing it however. This is why people seem to have different opinions about how enforceable those EULA slips that come with the game really are. The information, especially regarding the kinect, is as clear as mud. So you can turn the xbox off, but they didn't actually state that doing that turns the kinect off and while the xbox is on you can pause kinect. All I get from that is there is no way to turn the kinect off completely and still have a functioning X1.

There isn't anything they can say that will make the people worried about this feel better, though. They've already said it can be turned off while the Xbox is off(they've also said you can turn off the part where it's still listening).
The people calling it a "spycam" aren't going to believe anything Microsoft says anyway, so whatever they say is irrelevant for them.

It boggles the mind that microsoft haven't figured out yet that telling customer to basically bugger off is a bad idea. Brand loyalty isn't going to save them if they continue on in the same stream in their responses to feedback.
I personally don't think the exclusive title draw will save them either but then I'm not a Gears of War fan.

Basically, it has to get litigated out. If the law is ambiguous, the boundaries of people's rights aren't clear until an actual case comes before the courts and a judge rules on it in a given jurisdiction. Whether or not the law actually will enforce the very harsh terms found in a EULA is, basically, an open question.

They are not using consoles/devkits, they are just running PC games on Nvidias GTX 680 (~twice the power of XBone).
For all we know the XBone doesn't even exist yet.
