Does he come free with any new copy like Shale, or do I have to waste money on a CE or something to get him?
Regarding the DLC character.

I believe he comes with every new copy of the game.
That would make the most sense.

Bioware has stated that day 1 DLC is going to be free of charge to those who have bought new copies of Mass Effect 2.

Wait, so after the day it comes out, you can't download anything for free? Plus, release dates are different for each country and some people might get pre-orders late.

It'll be free for a stated amount of time like shale. I think the deadline is April 2010. Then the codes will no longer work.

You can't download them for free, they will have a price-tag.
However, if you bought a new copy of the game, it will have a card inside with a code that allows you to download the content for free. So, you can't DL the content until you have the physical copy of the game (or the e-mail, in case you got it Digital).

If it's like Dragon Age, then you'll essentially get a coupon in your new copy of Mass Effect that'll have a redeemable code for the DLC in it. Those who buy their copy used or rent it will have to pay to get this DLC which people who purchase it will get for free. The reason why they're saying Day 1 DLC is free, is cause only the stuff released on Day 1 will be free.... anything released at a later date you'll have to purchase.

I do not think they will start charging at that point what I think that deadline is for is for their automated system to take codes down and the ones not used by April X will just be recycled back into the automated system. Dev stated that new games will get shale and BDA free til the game is discontinued from manufacturers.
