It is not the authority statement, it is the actual state of affairs statement. The official policy is set by BW and if it is not violated, nothing bad is happening to nobody. It means that BW sticks to official policy firmly which is quite expected.
Older games, like Baldur's Gate and all Infinity-based games were modded to oblivion even though BGT basically rewrites parts of the plot and completely remakes multiplayer. Yet, BG-EE gets some legal issues and is essentially shut down. But if there is no money making involved and contents is free for everyone, there should be no legal grounds for any action. Also, cannot ban everyone and there is no point.
