Just because some people may want a refund it doesn't mean they need to seek legal advice.  I've returned 100's of items, yet haven't once considered taking legal action.

"I" am playing wannbe solicitor?  No I wanted to know how valid that was and where it was applicable..I don't profess to know any "legalese" but I do like to be well informed of my rights in any case.

And being that you are posting "laws" from England that don't necessarily apply in other countries,  thats a bit misleading for the average person reading it.   There are people from all over the world that read these forums, and thats why I asked if it was international law.

Thats it..perfectly reasonble to inquire about your source of information.  Methinks. :D

Probably not..hehe as it does state right on that page that its not professional legal advice, and personally thats the only kind I would pursue, if going to spend the bucks to do it.

Oh and I have no intention of that hehe.  :D

I dunno Fera, considering your track record and what looked to be the tactical sarcastic use of the smiley at the end, I'd say that assumption prolly wasn't too far off. Though why it upsets certain people so much that folks are a tad annoyed at the absolute poor way Bioware has handled the whole situation is quite puzzling to begin with.

I mean you would think that there would be a threshold point where even the diehard defenders would finally say enough is enough its about time we get some closure.

Cautiously optimistic is good, but I'm not getting my hopes up.  But as I sai din another thread, some news is better thanno news, even if it is bad.  Atleast I'll be informed.

IIRC, in the film version Veruca Salt wanted a Goose that laid Golden Eggs and threatened "And if I do not get what I am after, I'm going to scream!"  There has been alot of "screaming" in this thread.  Considering that the "Goose / Squirrel" in question has a life expectency of about 1 hour (give or take) the amount of "screaming" is hardly warranted or constructive.

For the record, I want my "Goose / Squirrel" too, but am willing to wait as long as necessary.  My Microsoft Points will not evaporate, and I have Mass Effect 2 to occupy my time; among several other games / activities.  DA:  Origins is currently temporarily on the "back burner" for me and (I would guess) at least a few others who have also purchased Mass Effect 2.

about the same threshold as the diehard complainers get the idea that it happens when it happens.
cant have a one sided coin.

but that goes againt those that feel the need to rally their posts about how put upon and cheated they are into some form of righteous anger, so of course, ill get quoted and "shunned" as being uninformed and a fanboy bioware supporter or some such, so ill just sit back and giggle some more as the posts roll in.;)

Fair enough though seeing as though most of us would put Bioware on a higher standard than most of the rest of the industry due to the quality of their work. Its all the more annoying to see the ball dropped in such the fashion as it was.
I've said before I don't feel cheated, just disappointed in a complete failure in basic customer support and communication, which I'm at a loss to see how thats really defendable at this point.

Its really the principle of it, and I'd like to hope that its an isolated incident and won't become a regular occurance what with their plan of going pedal to the floor so to speak with DLC.

oh i gladly give you disappointed,wont argue that one iota.
ill gladly give you, they could have handled this completely better than they did.
no quams there at all.

but to raise my blood pressure over it? naaa, theres too much in life that is much worse on a day to day basis to let myself get bent over some dlc issues and release delays. consider me jaded that way i guess.
if a delayed content issue is the worst thing that happens to me in the next few months or so, ill consider myself lucky. just kind of how i see it personally.

Oh good, we get  our daily condescending and active/passive-aggressive wall of text from Poisd2Strike, that could have been written in 10 lines, but he obviously felt the need to bore us with 10 times as much.

1: you know, being part of a bigger company doesn't mean you lose any decisional power on your products. If EA made a deal with Microsoft or whomever else, Bioware could have definitely opposed that idea, and given the way companies like EA work, they would have been listened to. If they decided not to go against it, it's their responsibility. And in any case, Bioware or EA, a promise has been broken, responsibility falls on the ones that made such a promise. You don't make promises to customers if you're not sure you can keep them. It's really that simple. Unless, of course, you want to put up a smokescreen to keep the customers happy til it's too late. And in that case the practice is even more deplorable.

2: you're not really sure who is privy to what here, right? Given that Microsoft and Sony have exactly the same certification procedures with basically everyone that produces games for their platforms, it's definitely not THAT hard to be privy to them, wouldn't you think?

3: Misleading -> Causing someone to take an action with a false input. Doing so maliciously of not really had no bearing to that.
Bioware gave a false statement, prompting their customers in buying the points. Hence, customers were misled. Intentionally? No. Does Bioware have no responsibility? Of course they are responsible.

You can keep the pedantries about "you purchased points for the sake of having points". They announced the release of RTO, prompting us to buy the points for that. It's really that simple. Cause -> Effect.

Damage? Who is talking about damage here? You really need to go see a few seminaries about customer satisfaction, instead of drowning in legal aspects that you don't know anyway. A company holds more responsibility to their customers than what the law states. No one here is raising a "let's sue bioware!" stink. People here are telling that Bioware is behaving in a way that it's no way ethical towards their customers. Ethics and Law have very little to do with each others.
Funny thing is that one of the basics of customer satisfaction is that hiding behind the "we didn't do anything against the law" is the worst course of action for a company that behaved in an unethical way with their customers. Mind you, informative communication is, instead, one of the best courses of action.

4: if you don't justify their poor business practice, then why do you defend them? For the sake of it? because you feel belligerant? Or maybe you simply like to read your own words (that could indeed give us an hint on why your posts are so unnecessarily verbose)?

And don't worry, while my posts might constitute a sizeabl part of this thread, Feraele beats me hand down. Why don't you ask her why she's here given that she has the PC version? Oh, of course because she happens to be on your sime side. 
While the title of the thread is plenty misleading (and should have been changed long ago), the post happens to talk about "all platforms". Did you even read it, or just barged in to try and flame?

I seriously find it absolutely comical that you accuse anyone else of
rudeness, insulting and condescence, since you have done absolutely
nothing else since when you decided to try and turn this thread in your little classroom. I understand that you're infuriated because someone stood about your ego-ridden truckloads of words, but you might want to calm down.

Victor promised an update for later today (a tad late for my taste, but I'm always welcoming communication with open arms), let us hope it to be actually informative. At least that would meant that Bioware would have understood that they need a change of pace in communicating with the ones that pay their bills (even in advance, it seems).
