You can't fail it, the only question that really matters is Anderson or Udina?

 

You can choose a different one than you did in ME1, but whatever you say is treated as true. This is because the save import from ME1 occurs just before your final fight with Saren, so the game doesn't actually record the person you chose afterwards.

Does Genesis ask who you chose to be Councilor? It'd be pretty amusing if you chose one guy in the comic, and then another during the interrogation that comes right afterwords. "Hey, didn't you just say Udina? Why are you changing your story now?"

I believe if you mark who the councilor is in the save editor then Miranda doesn't ask you that question.  I assume it works the same if you use the comic.
