There is no freedom of speech in a private forum. Likewise I cannot enter your home and say whatever I want, you have the right to call the police and escort me from your property.

A comparison would be to enter a police station and start shouting you've got several bags of weed and are also willing to share your cocaine supply, only to act surprised when the police arrests you.
Freedom of speech means you can discuss about piracy all you want, but not on the developer's own forum, which they own, meaning they can set whatever rules they want. Unless of course you also just let any stranger into your own house and let them do whatever they want?
