Neither EA nor Bioware are mind-readers - how can they possibly be blamed for a company collapsing? If GAME offered a better deal to get the exclusivity rights to the ME3 Collector's Edition, why would any business turn them down? If they were keeping their financial situation secret, it's ludicrous to expect a publisher to somehow anticipate their bankruptcy.
Exclusivity deals are obviously profitable for EA, if they keep doing them, and since they're a business with an interest in making money it'd be stupid not to do so.
You don't have your facts right. GAME didn't go bankrupt. It still exists now.
There was a falling out between EA and GAME and EA refused to distribute future titles to GAME.
EA made an exclusivity deal with them and then completely ended all business relationships with them several months later. While it was brought about by GAMES growing financial woes they had been publicly known about for awhile (several GAME stores in my area were shut down and the financial issues were well-known).
It is entirely EA's fault for agreeing to the deal with a company that was struggling and then backing out of it last-minute.
