Well, ok, you can get promoted while dead, but it's still fairly logical that Shepard wouldn't get promoted.

 

Actually I would think it would make sense for him to be posthumously promoted. He gets KIA only about three weeks or so after the Battle of the Citadel, and you would think there would be some recognition for the role Shepard played in that battle and in stopping Saren. A posthumous medal and/or promotion wouldn't be out of order or unusual, if the Alliance was anything like real world military organizations.

When Shepard is referred to as 'captain' they are referring to his billet. There is both a Captain (capital C) rank and a captain (lower case C) billet. That might be a bit confusing for people who haven't served in the military or who are unfamiliar with the differences between rank and billet, but they weren't referring to the Captain rank. A billet is sort of like a job within a unit. Fireteam leader, squad leader, platoon sergeant, executive officer, and commanding officer are all examples of billets. The commanding officer of a ship is also commonly referred to as the ship's captain, regardless of that officer's actual rank. Some classes of ship are led by Commanders, yet they still are referred to as the ship's captain. In those cases the word captain is referring to person's billet rather than their rank.

 

That is basically what was going on when characters refer to Shepard as 'captain.'
