Cole may be child-minded but that doesn't mean he acts exactly like a child and shouldn't be thought of one. The consent issues that surround a spirit are slightly different to a childs and cannot simply be considered to be the same. For instance, Justice is perfectly capable and aware of the repurcussions of killing people, his prerogative is justice after all, but that doesn't mean he can consent to sex, something to which he, as a spirit, probably has no innate understanding of. That's why Cole is allowed to kill. As far as I know, Cole is a spirit - the wiki says he is - not an adult being who lives on the plane of mortals. You can't project the idea of adulthood onto a beings who don't experience time.
TL:DR As far as I can tell from a quick read up, Cole isn't human, he's a spirit. The adult-child understanding of consent does not apply.
