If you even can Judge a party member, it'll probably be Vivienne. She seems like the best bet if a party member is going to betray us.
Edit: Well, actually either her or Iron Bull given the latter's token affiliation with the Qun. Though that seems like it should be easy to avert, either by co-opting him completely or by having him impress on the Qunari how serious the situation is and how there is nothing they can do to fix the situation except to let the Inquisitor do his/her thing. (I'm not sure what I'd do with Vivienne, if it came to that. The Bull, though? If I told him to put on motley and do a dance, he'd probably enjoy it.)
I won't carry out any executions as I take the Amnesty International approach to the death penalty, and I won't use the rite of tranquility either for similar reasons, or humiliate anyone by making them a court jester. I'll have to see what other options are available with each judgement.
I believe the other options are supposed to be pressganging them or letting them off scot-free. The latter I think is dangerous with anyone who isn't way too scared to ever lift a blade to one of the people under my protection again (which is complicated by the fact that ruling through fear doesn't work all that well), and the former presents some potential problems too. That said, I agree with you that execution is a distasteful method of dealing with enemies. (Tranquility is an option, I suppose, for anyone who is too dangerous to recruit.) As for the Dontos Hollard option, how many fools do I really need?
(I think flogging might also be an option, but my objection to that? To the best of my knowledge, it just doesn't work.)
I think BioWare Edmonton may have played through Fable 3 a few times. One of the few things I actually loved about Fable 3 was being King of Albion and deciding the fate of various individuals while sitting on the throne. BioWare seems to be taking cues from that and incorporating it in an even better way to really show the power of the Inquisition.
I hope the decisions are predominantly moral dilemmas where it's less of a "right" and "wrong" approach and more of just choices with consequences. That's an approach that served The Witcher 2 extremely well and really leads to a much more interesting and compelling experience.
It's going to be really interesting and exciting if BioWare can really pull off the sense that we, as the Inquistor, really are leading this large organization that is able to project power over a vast amount of territory. I'm somewhat concerned that it will be little more than just micromanaging the war table and occasionally having cut scenes to deal with a problem.
I doubt we'll have any really large-scale battles in this game. However, with how large crowds can be in AC Unity, at some point I want to see full-scale wars with thousands of NPCs participating simultaneously. More or less Dynasty Warriors except not ridiculous, but amazing, intense, and epic.

That might be all we get though, there doesn't seem to be a prison and i wouldn't just let someone who committed a heinous crime walk free.
We have a dungeon. That's sort of like a prison. And depending on the crime maybe they could be put to work in the army instead.

The word "them" in the context of Tranquiling prisoners seems to imply a plural. (Occasionally the word is used as a singular pronoun when trying to not imply a specific gender, in fact I know a guy {for lack of a better term} who prefers to be referred to that way, but the word seems to be referring to the plural group of "people you can judge.")
He was talking about the whole options we have in judgements. He said we can set them free, execute them, makes them jesters, tranquilize them. I don't think every option will be available in every case. What if you use a war hammer as your primary weapon? That could get messy.
