Viacom Mass Effect Copyright Claim

There isn't really a proper place to put this so I'm just going to place this here.

 

Today I got a copyright claim from Viacom against a video that was part of a Mass Effect 2 playthrough I uploaded more than a year ago.

The claimed content is just some planet scanning but apparently that was in a Viacom owned review of Mass Effect 2. However, while this may come close to what was in that review, this was actually from a recording I did which makes this a BS claim in my opinion. While I don't make any money off my videos, this is just something I do for fun, it is still really irritating.

 

Does anyone on here know of any statements from BioWare about their policy on recordings and if so could you point me to it? If BioWare hasn't made their position on recordings clear, it would be nice if they would do so so that those of us who do this stuff for fun can avoid these situations, and it would help combat illegitimate copyright claims which really irk me in general.

This list from game-informer indicates to me that EA and the studios EA owns have never made any kind of statement. Granted that article is from a year ago, but they indicated they would update it as they receive responses and I've never found any other statement online from EA or Bioware. I've had a handful of videos muted due to copyright claims from third party companies clearly unaffiliated with Bioware/EA, mostly because of ambient soundtrack music.

If you recorded from the game, you can't actually have content owned by the reviewer, and any footage they take from the game really should not count as their content.

 

You can attempt to file a dispute and see what happens.  They might drop it.  If they don't you can always appeal it.

 

The only downside is that if you eventually lose the appeal it counts as one strike against your account.

I remember seeing that when it came out but hadn't seen anything since. However, I just did more digging and found this http://help.ea.com/e...-games-content/

 

I've also had plenty of videos get flagged due to soundtrack and what not but this is the first time I've had a Mass Effect video get blocked due to a claim. The only other one I had blocked was because it had a cutscene from the Tomb Raider reboot and that one actually got me a strike until I deleted it.

My only concern is that I don't really have any grounds for the dispute options that are listed, other than fair use maybe, so it could definitely backfire. However, maybe this EA permission request thing is the way to go about this.

They filed a copyright claim against you, because your game 'review'/playthrough featured a game mechanic of the game which they also featured in a review of the same game?

 

I don't even....

Not sure Viacom themselves actually filed a claim. Could be Google/YouTube's automatic copyright detection system which has been known to falsely flag videos for copyrighted content.

That is likely what happened. My understanding of the detection system is that copyright holders have to select what content they want to add to the auto detection system but I don't know if they can be selective about which portions of what they add will be checked. This isn't the first time I've had ME videos get matches to reviews but it is the first time that the video has been blocked world wide.

Yes it is the auto-detect, that is why you might as well appeal.

 

Try fair use, IIRC there is also a point where you will enter a comment and you can input pertinent info.

Apologies to bump up this thread but i just got hit with this myself on my 8th gameplay video. Viacom say they own the rights to the content shown (Which, according to the YouTube timestamp is just a clip of my commander shepard looking at another character that at that time is unseen. So basically they are saying they own my shep! :P )

 

I'm disputing it under fair usage and will see how it goes. YouTube have given Viacom until 15th Jan 2015 to respond...i dunno what happens after that.

 

Will update on how the dispute turns out...if it ever does. :huh:

For my appeal they never responded and as a result the claim was removed. I've had two hits against ME3 cutscenes as well but they are still awaiting response.

Ah, thanks for that info! I'll guess this is all YouTube's auto flag system then :blink: On the plus side the video seems to be viewable...at least by me. Yay? :mellow:

What I've found is that once the appeal process starts the video becomes unblocked for everyone.
