I think this quest is a lot easier if you have the nobility inquisition perk etc. I had a lot of extra options when talking with people, and it was easy to get my court approval rating to 100. However, I didn't choose to just arrest the duchess (which I thought was a trick) so I had to fight her with no health potions....at all. None. The thing that bothered me was that I didn't realize that I couldn't go back to the location once I left.

Yes he will testify even if you recruit him...you asked "will I loose out on him testifying?" and I replied with no...sheesh.
