Anyone that downloaded the CE armour/weapon DLC is a thief and should be prosecuted accordingly.

This DLC was always intended to be free? Okay try explaining that to the millions who spent extra money on the CE to get that armor. Or preordering to get inferno and terminus gear. Or buying DAO to both play the game and get that armor. Or pay 15 dollars to purchase the Cerberus network card to access half the items that were available to download - for free.

Microsoft owns xbox, they aren't in anyway part of the development of ME2 - no more so than Dell or HP or any other platform manufacturer. They fall under third party.

A third party illegally distributes copyrighted property - that's what piracy on the internet is. If it was intended to be free you would still be able to download it now.

What is different was that the distributor was an official game developer, a software giant in the corporate world. I bet MS higher ups never even intended for that content to get out there, probably some mid level employee did it while everybody else was asleep.

Is it piracy? I just explained to you why it is so explain to me how it isn't.

But the items themselves never had any value tied to them. And Microsoft is an official distributor authorized by EA/BioWare to distribute their content. Piracy is taking something from non-authorized distributors. If anything MS has a final say on how they handle XBL and EA has no say there. MS entered a trade agreement with the people who wanted the content free when it was downloaded. There was nothing on the download site mentioning any sort of requirement to get that content and the only thing hintingat a price was the 'FREE" price tag.

If anything EA can take MS to court but that won't happen...not over a few thousand downloads on a game that is likely to sell millions of coppies and MS no longer has the right to take what they willingly agreed to unconditionally give for free.

It was a lucky break for those that were quick on the draw when those items were up for grabs.

Course nothing will happen but I'm pretty sure in the trade agreement there wasn't a loophole saying that on such a such a time MS can distribute free DLC prior to the ME2 release date. Just like how we game owners have to sign agreements saying we won't distribute this software illegally.

Be nice if MS would reimburse the lost profits to BW and the other companies (pepsi for example) but again, I doubt it.

The point? When people were on here downloading it they knew what the hell they were doing. It was available and instead of holding back they went for it. Same thing as internet piracy on the torrent tracking sites. Trust me, I was here in the forums when they were doing it and PC users were flipping out over how "unfair" it was.
