So... WHY is Collectors' Edition stuff available for FREE on XBL?

Okay, seriously now, Bioware, you're pissing me off.
I have spent extra money, and at this rate, the only truly unique thing I'm getting is the tin. What the hell? First the Cerberus Card, now the Collectors' Equipment which was touted as "EXCLUSIVE to the Collector's Edition of ME2!!!"?
So... while the Cerberus Card wasn't worded in such a way, Collectors' Gear was specifically said to be totally exclusive. What's the excuse now?

One way or another, I spent an extra 10 bucks (and had to commit to buying from an alternate store than Gamestop, for that matter, as GS ran out of the CE as we all know).

This is ****ing fraudulent. We paid money.
Bioware needs to deal with this crap, I can't deal with MS, I can only deal with Bioware and trust me if this continues they will pay.

The excuse is simple and rather pathetic if you ask me: Someone at Microsoft messed up and BioWare doesn't give a damn since they already got your extra $10, or in my case, extra $45. As I've said before, BioWare got our money and made their profit$ to line their now even fatter bank account$. They don't care about false advertising nor do they care if people are rewarded for STEALING and being irresponsible (those who downloaded the CE armour, etc.).

Like you said blame Microsoft, they're handling the data for the 360 version and it is their fault that this mess even started up.

i got no idea how someone could get it from his xbox though
edit: i got a CE coming by mail just wanted to see if it was working

They weren't, kiddo.
It's not available for free to those who don't have the code. You would know this if you checked it out yourself, like I did. An error pop up message comes up to tell you it isn't available for download.

An example is that final fantasy 13 chocobo avatar prop they gave out as a promotion a few months ago. It was free at the time and all you had to do was click a button while logged into live (on the site that is) to get the code emailed to you. That little chocobo is listed in the avatar marketplace but it has a cost of 99999 ms points. Removing that listing would require it be /entirely/ removed from the marketplace and live itself, causing the item to no longer work for the profiles with it.

Clearly, I wasn't able to access XBL at all or anything (roommate's asleep), but I found a blog post excited about the free DLC that 'appeared on XBL earlier today as an apparent mistake' and that one of them was "Collector's Gear, still listed as free". And, obviously, there's an actual Marketplace entry for it that agrees with that claim.
