I just recieved my bank statement and notice a foreign transaction fee. Called the CC company, they stated that its from purchasing the BioWare points caused the foreign transaction fee. Where does it state that I will be making the purchase out of the country!? Is it posted somewhere I didn't see?

The transaction would be either in Canada, or the US (depending on whether it went through BioWare or EA, and which branch of BioWare). Currency conversion fees are normal regarding credit cards.
