Hey Guys-

 

Question, so last night we get this major as$$hole on DAMP talking borderline sexually suggestive stuff and basically being a dick..

 

So I call him out because no one else would and told him to go fuc5kkk himself but he kept on going and the whole time I was thinking if this guy doesn't care what he says to me (an old man), what would he say to a minor or someone who won't speak up? I have two kids and if he said this to them I would break his knee caps. Has anyone ever read the privacy/content/sexually explicit waiver that I am sure Sony/BW has given us somewhere?

 

IMO sexually explicit content to a minor in a forum setting can be both a state and federal statute and most attorneys love to prosecute predators/weirdos. I am half-way considering asking my Attorney to send them a inquiry asking for in- game IP addresses/voice chat if available at the time I was on. We crashed to blue screen the game after so I was able to log a crash inquiry and can pinpoint the time and members in that chat.

 

Total BS that some loser has the carte blanche to say what they want IMO.

Usually I don't give a crap but at some point there has to be a line drawn.

 

What you guys think? What would you do?

Don't you have the option of reporting players on the playstation? That's what I'd do if it were on Xbox.

on xBox you can report and/or block communications, not sure what xBox do with any reported players but I am sure that if they get enough reports there might be a ban or some kind of penalty.. I do believe any reports go against a player rep.

I rarely get other people with mics on PS3/Europe but whenever I do they're nice, except for two French guys who talked something I didn't understand so I can't vouch for them.

There is a Mute option for players on PS3 and pretty sure the same setting is available for all platforms.

Reporting does go somewhere, it isn't just a dumpster. If you have to report someone you won't hear the outcome but, EA/Bioware does deal with it. (I have reported 3 people across ALL EA games I play, that's over 30 games, for in game language or actions and, it is dealt with, usually within 2 days but, can take up to a week.)

I don't know how Playstation handles it, but XBL does an investigation, and someone who does it consistently is likely to get banned from XBL (with that account, at least.)

 

You could also report them to BioWare (I don't know the method for doing this with DAMP, only ME 3 MP, and they don't really do anything with the ME 3 ones, anymore.) BioWare can't investigate him, though, at least not for communication violations. Nor is it necessarily a violation of any BW/EA ToS, but I haven't read them in entirety.

 

I'd Google "reporting on PSN for abuse," and follow whatever instructions you find.

Game isn't rated for kids, and online interactons aren't rated at all.

Unfortunately, from a legal point of view, that doesn't mean much in some jurisdictions.

 

Federally in the U.S., for example, it isn't illegal to sell games rated "M" to anyone.

Oh? I guess mom and dad are liable then. Regardless, a mature game should not be expected to be occupied by minors.

The tools are there to deal with foul mouthed idiots, use them. And if you have kids that shouldn't hear it, teach them to use said tools. Or you know, do your job as a parent and supervise their online actions.

I wasn't talking about taking legal action against the guy described in the OP. No one was (except you, for some inexplicable reason.) I was talking about the fact that it isn't illegal to sell video games to kids, regardless of the rating. Consequently, whether one shouldn't expect kids to have it, or not, it is a basic fact of life that they will.

 

It's pretty much an accepted reality that kids of any age play any video game regardless of content.

 

My point was that the rating system doesn't have any real impact on whether a kid is exposed to something, which is tangential to the point the OP was making. Online behaviour is governed by an agreement signed with Sony or Microsoft, and that is what everyone making suggestions has told him. The person in question would probably be considered in violation of those rules.

Playstation doesn't do anything. Xbox block will lessen the likely-hood of playing with that person again, and if enough people send a report with proof, they actually can get banned or suspended for a time. Xbox for some reason actually do investigate the issue, idk why Playstation does nothing.

 

I own both consoles.

Everyone rushes to take legal action, nowadays. It's sad.

 

 

I know you're angry and probably want to genuinely protect others from that language, and I respect that, but legally prosecuting a kid because he trash-talked on multiplayer is overstepping the line. Mute him or leave the game.

PlayStation definitely bans accounts for abuse. 

 

I think people are given a warning and if it continues then their PSN perma banned so best thing to do is to report people.

I confess, I didn't notice that line. Going to a lawyer would be an over-reaction, but I'm going to chalk what he said up to being upset by someone being a jerk online, rather than making an issue of it. He didn't say he was going to do it, so I assume he was saying it as emphasis to how upset he was.

 

You quoted what I said as your opening line, which was why I assumed you were directing your comments at me.

Report and block him is probably all that you could've done unfortunately. Be glad that you could even report him on console. On PC u can only put someone on block list and that's it. There is no report system on PC. Sigh, Internet is good but unfortunate all the rapists and paedophiles are using it too.

It's not a legal issue so much as a corporate policy issue. A GameStop employee can be fired for selling to someone under 17 but not prosecuted.
