EDIT: To add to my point, I suppose I should phrase it like this. Are you doing Let’s Play because you enjoy it, or are you doing Let’s Play because you think it’s an income source? 

 

Would you ask the same of any famous actor?

 

Do you think Christian Bale started acting because he thought it was a source of income or because he enjoyed it?

I don't know the answer to that. But I don't see the comparison either.

 

Anywya, the real point was generally discussing Nintendo's new policy of sharing add revenues with Let's Players, which of course they are well within their right since the said content is theirs and the case of copyright law restricts certain contents to be utilized for profit for consumers.

People that go to drama school do it because its a hobby. People that go to football do it because its a hobby.

 

Some get lucky and are able to make money out of it. Like Christian Bale or Christiano Ronaldo.

 

I don't see how its any different from people that make money with Let's play's. 

 

Its literally the same concept.

Its literally the same concept.

Education isn't a hobby -- Football, however, is indeed a hobby. Christiano Ronaldo plays professional football, meaning it's a job and thus he receives payment for his services. Acting ranges from being full-time, to part time, to voluntary work.. people who wants to be an actor don't usually expect payment given that's a profession where experience is key, and most of the time.. it's voluntary. As for Let's Players -- I wasn't entirely sure if Let's Players are self-employed, meaning they do pay taxes in regards to the income they get from their content, which I understand that people like PewDiePie does in which case I can see the distinction otherwise I cannot.

That argument would hold, if it wasn't the case that they are deliberately profitting from it, something which doesn't belong to them in the first place, thus Nintendo is in the right and they should just deal with it. Let's Play's is not a job profession -- The whole concept, much like a walkthrough, functions as a hobby, where people chooses to share their own opinion, helpful knowledge on a game to those who might be interested in such. It doesn't matter if Sony or Microsoft haven't done it, it doesn't make it less right for Nintendo to do it. These are the kind of people who feed on subscribers, platitudes and tired ass-kissing commentary "Oh mah god THIS GAME IS SO AMAZAAA -- Don't forget to subscribe by the way". The kind of expectant self-gratulating drivel that makes me want to play squash with my ears. 

 

Nintendo could have chosen not to share the profiting revenues with the Let's Players but they did -- I'd say that was a fair compromise, anyway.

 

Problem is that a lot of people have decided to make let's plays and streaming there career so even though Nintendo does have a right to collect Revenue the let players do everything they can to make them look bad or not show Nintendo content which has hurt Nintendo from a marketing stand point due to the increase in people watching Live Streams and Youtube more than more traditional media were Nintendo can more easily control advertising.

I suppose you could argue it's not a sound move from an image standpoint, but Konami, Sega, Capcom and others have already moved out on copyrighted soundtrack content on Youtube -- At the moment it might seem like Nintendo is alone, but it wouldn't be too far fetched to think that the rest are gonna follow suit. It's something the said Let's Players should have seen coming, as the way I see it -- This is the future of Let's Plays. Sooner or later someone wants to get their share of the pie.

Well the main argument for YouTubers is that let's play falls under fair use which states that Nintendo doesn't have a right to collect revenue on somebody else's commentary video, even though Nintendo games are being used.

 

The thing is that legally it's a rather grey area that nobody really knows. Developers are still able to take down videos however because of YouTube's fairly terrible anti-copyright system that shoots first and asks if you were actually guilty later.

 

It's all ultimately dependent on if Let's Plays get to enjoy the same fair use laws that things like game reviews do. As far as I know, there hasn't been any major legal rulings on the matter and it's been entirely up to YouTube to decide who is in the right.

 

In either case I think right now at least it hurts you to go after YouTubers because you lose that free advertising and it's seen as a greedy move in the eyes of a lot of people. Given that indie devs are more than happy to have somebody throw up a video of their game and get all those free views, I don't think we're ever going to see it going away. The major devs might win for their games, but all that will mean is that people avoid playing their games in videos.
