the American Law Institute is promoting passing laws stateing that ANY physical contact from hand holding to bumping in to another person with out concent can be classed as a Sexual assault. and no not on a collage campus this is a proposed law.
Lol, stupid academics. The Criminal Courts will be so backed up the litigation weight will be accounted for in decades.

I'm a classic liberal, so I'm a bit worried myself. But history repeates time and time again. The armed forces, and law enforcement sects of government are usually made up the lower social classes. The class that these academics are dragging through the mud. Happened in Russia. Cambodia. France. It's always the same. Your books won't protect you from an angry Tyrone and Cletus, skin color and gender be damned.

Same. A classic liberal is a libertarian by today's standards though. Some seem very socially conservative and will let other social conservatives trample on people's freedoms too. They team up with Republicans too much. The only well known one that isn't like that is Bill Maher.

As far as I could make out most of the focus of the discussion paper is on acts which most people would consider to be in the normal definitions of sexual assault, requiring use of a sexual organ. The sexual contact discussion seems to have been reserved and put aside, keep in mind that sexual assault definitions would include conduct where the victim is a minor, where most people would see any sexual contact as being inappropriate.

So I made a mistake here. Even tho I was right in trying to remind people that what's at issue is a discussion paper, the discussion paper i was skimming was actually an earlier draft. However, there is another wrinkle here. The lawyers and professors in the letter criticizing the discussion paper suggest that its concerns about sexual contact less than actual sexual assault can be addressed in tort law or in another area of discussion carried on by the ALI. To me this amounts to an admission that there needs to be some legislation addressing this issue. At the same time, depending how court access re intentional torts is dealt with in the US, this may mean that remedies may only be available to those victims who can afford the private legal costs -- which may be one of the reasons the discussion paper in question (apparently) pushed for a criminal law approach.
