OK, so to successfully download the dlc you need a bioware account with the same email address that is linked to you gamertag, and an EA account that is also linked to the email address that your gamertag is aswell? Is this right?

Not quite.

Your XBox Live gamertag needs to be linked to your EA account (a Bioware Social account is an EA account).

When you first run ME2, it will attempt to set up this link for you by looking for an EA account with the same email address as your gamertag. If none are found, I believe it will prompt you for login information (not sure, very few people are talking about this and it automatically found mine).

If the EA account that shares email addresses with your gamertag is not the one with DLC attached to it (for example, it is an older account from another EA game or an alternate gamertag on the console) then you can call EA Customer Support (number of the back of the manual) and they will help you transfer your XBL gamertag to the correct EA account.

Once that is done, there is no requirement for the email addresses to match.

Thank you very much. For anyone else out there who is having problems with their EA account, what i did was instead if ringing them, i sent them an email explaining which gamertag is to be linked to which email address and they sorted it all out for me.

I emailed EA. Go to support.ea.com then from there click on the option email us and enter the relevant console, game and then go to account linking. From there you can see what EA wants you to include in the email. Should take about a day for a reply.
