I think they should let him do it just for laughs and hire Kimbo Slice or something as the court champion.

Well I gotta admire the guy for trying however if he is trying to throw a spanner into the cogs of the US legal system just because it has never officially been outlawed in the United States does not mean there is a precedent, don't believe there is anything in the constitution that states if a person does not trust a fair judgement from a jury of his peers he can take the matter to the gods in a trial by combat (please correct me if I am wrong), has there ever been a trial by combat in US history?

 

What about the methods of trial employed in the Salem witch hunts? What is the status on them? Were they officially outlawed or were they only for testing witches? Probably not the best method to ask for if you plan to live through to the end of the trial though.

No, not per se... but there have been pistol duels on the White House lawn? I mean... that's a form of combat, I suppose.

Well, the Salem Witch trials were before the founding of the country and wouldn't play into any legal precedent except as an antecedent example, I believe. <taking comment way too seriously>

So my understanding is that he's basically using the Air Bud clause of "Well, you never specifically told me I couldn't do it".

 

As amusing as it would be, I can't imagine that they're actually going to allow this. On the off chance that they do, they would shut it down pretty quickly otherwise everybody is going to start doing this.

Yeah, the idea rests on a certain loophole you could use via the Ninth Amendment. This article goes into a bit of detail, though it's a couple years old now:

Of course, you're probably right that even if this does work out, legislation would probably be passed to outlaw it soon after.

As others are saying, even if this was allowed it'll get taken care of immediately afterward so that no one does this again. Otherwise trial by combat will become quite common in today's age.

This is dorky. However, I wouldn't mind the option if it was a common thing. :P But trying to do it in isolation is just being a smartass. This guy should just be slapped....without a trial by combat.

I love that we live in a world where something like "the Airbud clause" can even be theorized about.
