Was he ever confirmed as dead, dead. They were fairly ambiguous as far as I can remember. Mostly dead, mostly meat and tubes etc. but I don't remember a full yeah dude you were dead for like months and we brought you back.

HBO flat out said Jon Snow was dead and not coming back. This has pretty much been proven false and everyone is expecting to see Kit Harrington back next season.
This means that Bioware can lie about Shepard all they want.
Heck even indoctrination theory might even prove to be true in Andromedia.
Never trust what developers say that is not explicitly in the source material if they are making a sequel. If they were not planning a sequel what they say about things would be more true.
But the fact of the matter is if they have an upcoming game they will outright lie just like HBO did.
When did they say "not coming back" where did you get that from? I only heard that they said he was dead.
I always assumed the red lady was going to bring him back right after he was killed.

Think about this logically. You are a writer and have the option of two different characters. You can write a new character that is a blank slate and you have almost free reign to do what you want. You could also write for an established character that has three games of history that you need to include or else people will hate you. You also need to shoehorn that character into the story in a way that will most likely feel cheap. What would you choose as a Bioware writer?

Given Shepard's moronic comments in ME1 like comparing the FCW to the Genophage and being surprised that the Asari can reproduce with each other, it sounds like he was brain-dead from the start.

And Jon can't be dead anyway. For one, they wrote in the whole thing about keeping Jon's mother a secret into the show. Killing off Jon means that plot line doesn't conclude. And technically, they (HBO) may not have even lied. He might be dead, like Beric Dondarrion when he got split in two, but then get brought back to life, like Beric Dondarrion, with the help of Melisandra.

Jon is dead. Jon may be back, but not as you knew him. So what HBO said is "true, from a certain point of view." Personally I think he is coming back as this.

Lazarus = Reaper tech, = gone in destroy and with the plot device Mac Walters chose to try and make you choose synthesis.
You live...for an agonizing few more seconds. Oh and they show you that you synthesis was basically canon or what Mac viewed as the correct choice with that stupid end of Ragnarok, Eden scene. Symbolized a "brave new world" and Mac Walters even wrote that in his notes.
If you want Shep to live, the only way is the MEHEM mod, where you remove the plot devices Mac put in and the entire Starkid conversation. The mod had to remove that conversation because then everything would be FUBAR with logic (and already was to begin with).
Synthesis? He dies. Every INDIVIDUAL dies. You are all dead. You are a Borg now. Control, welp we have no reason to trust these ahole reapers, but if you do, then I also view him as dead. Why? Cus if Paragon Shep controlled the reapers, my first move would have been to fly the Reapers into the @%%ing sun.
Could Shep ever appear again? Sure, if Walters wants to go with his original intention of synthesis being his correct choice, that he shoehorned in after watching 2001. We may meet synthesis Shep one day as an even bigger slap in the face, unless he makes synthesis shep the villian to show how dumb that ending was. Add to that Shep the individual no longer exists. The only way to ensure peace in Mac Walters flawed "immortality/utopia" is to kill sell and join the borg collective. He probably calls himself Locutus of Borg now.
