In ME1 if you make certain choices you'll hear that he got a wife and kids at home. By the time ME3 rolls around is he cheating if he gets in bed with Shep?

Umm, Kaidan is not married and has no kids.
If he is romanced in ME1, he tells you in an email that at some point after Shepard's "death" friends convinced him to go out with a doctor on the Citadel, but it didn't go anywhere.

interesting responses.
I remember hearing the news broadcast in an elevator ride that he's survived by a wife and kids if he dies on Vimiere

You could've mistaken Admiral Kahoku's fate for Kaidan's. The only news report that mentions something about "wife and kids" is the one regarding Admiral Kahoku.

I'd be curious to hear the exact dialogue options OP claims would lead to this statement.

And the text from the ME2 letter:
I'm sorry for what I said back on Horizon. I spent two years pulling myself back together after you went down with the Normandy. It took me a long time to get over my guilt for surviving and move on. I'd finally let my friends talk me into going out for drinks with a doctor on the Citadel. Nothing serious, but trying to let myself have a life again, you know?
