 Hello Bioware Devs, in light of the new MS class action suit, can we expect a point overhaul to avoid a similar circumstance in the future? After all your point system is similar in that $5 US = 400 points...

Microsoft's system for selling content through Xbox Live is anything but straightforward. Rather than using real-world currency or an easily understood conversion rate, the publisher has adopted its own system, where 400 Microsoft points is equivalent to $5. Further, Microsoft sells point packs only in multiples of 400, often leaving gamers with excess points after purchasing content that they want.

 Purchasing points has given at least one man a serious headache.This last point is the subject of a new class-action lawsuit, which was filed in the US District Court of Eastern Pennsylvania last week. The complaint alleges that Microsoft defrauded the class, which is led by Samuel Lassoff, by "collecting revenues for digital goods and services which were not provided." In particular, Lassoff's filing states that Microsoft contractually agreed to only charge for "the complete, whole, and or actual digital goods and services purchased."

Lassoff claims that Microsoft did not warn him, as well as the "hundreds" of others he believes are in a similar situation, of "point fraud due to incomplete and or partial downloads." He also notes in the filing that Microsoft did not offer any way to recover the unused points after he contacted customer support.

The complaint goes on to charge the publisher with negligence, unjust enrichment, and unfair business practices due to its pricing scheme for Microsoft points. Lassoff is seeking compensatory damages for the class, as well as interest and other damages as determined by the court.

He should of just bought some avatar gear with the extra points or just saved them for another purchase.....people complain over the most pointless stuff....but i dont think that bioware will be sued over there point system because they are way to cool. not to mention they would probably show up to court with there N7 armor and DA:O inflatable swords ready to do battle

The point deal from bioware or microsift is nothing but a crook. I hope this guy wins. They force you to give them more money than the value of the thing you buy from them. I hope MS get a heavy punishment for this.

I want the guy to win though, just because I dislike Microsoft and the crappy GFWL. I still got 800MSP left from Fallout 3 DLC.

It's like store rebate forms, you wait for 4-6months then nothing ever come in the mail.

By that time who will remember? money down the drain.

Of course you can call them up and pester them, lol.

The issue, IMO, would be if you can only buy in blocks of 400 points, but the content is charged in different amounts (600 points, or some such). Otherwise, I think this is frivolous. It's also off topic, so I'll move it there.

It's about time someone sued them. It's a deliberate scheme to screw over players because you will always be left over with points but not enough to buy something else to use the rest of them. Microsoft is absolutely charging for content that is never bought. The fact that they don't let you purchase DLC with straight cash debit/credit/PayPal transactions shows it's an intentional method to make players purchase more points than they want.

I don't think they will do it because after that every major retailer in the country would be able to get sued for offering gift cards if the precedent got set.

There is a difference. With gift cards, you have the option of fully using them, and then using a regular credit card or cash for the rest. WIth these points, its an all or nothing deal. You either buy it all through points, or buy it through normal cash, if they even allow it. What their point buy system does is forces you to buy through 400 point lumps, and then potentially can't buy anything using those last points. Additionally, his case is that he lost the points even though he was only able to partially download the content. He says that he was unable to finish the download, Microsoft denied a refund, and now the person is taking them to court for it. He is also saying that Microsoft gave no warning about incomplete/partial downloads using up the points.

in principal i am against suing over this garbage. it's as frivolous as frivolous gets. that said, microsoft does seem to stick people with excess points. if they sell something for 500 points and points in blocks of 400, you have to buy 800 to use 500. pretty disingenuous to me, but not worthy of a lawsuit. bioware seems to charge points you can buy in exact amount.

the official reason for the points system is that, and this is found on xbox.com, the minimum transaction for a credit card payment would have to be $5. now, i sure as hell do not want to pay 5 bucks for a single Rock Band/Guitar Hero song download, for example. HOWEVER, if they would allow us to add actual money values to an account similar to the PSN wallet, there would be far fewer complaints, and you wouldn't have to figure out a cryptic system.

edit: as for having leftover money... well... that sucks, but i'd be surprised if there wasn't something coming out along the lines that you wouldn't be able to spend it on. but being able to add a specific amount of money/points to your account would be nice.
