caching is a special use, which there are oodles of lawyers and miles of legal documents that make it very difficult to sue an entity like google over, partly because it's temporary, as far as fair use and assumed copyrighted content goes. *that* kind of internet usage (cookies, etc.) is woven into the ToS of most every website you can add content. what i'm talking about here is completely different.
edit, to note, the EA ToS addresses this specifically here:
XI. Public Information Including User Generated Content, Online Forums, Blogs And Profiles
You may choose to disclose information about yourself in the course of contributing user generated content to EA sites or games or in our online chat rooms, blogs, message boards, user "profiles" for public view or in similar forums on our sites and/or on third party sites. Information that you disclose in any of these forums is unencrypted, public information, may be accessed or recorded by EA employees, and there is no expectation of privacy or confidentiality there.
You should be aware that any personally identifiable information you submit in the course of these public activities can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to make public in any of these forums.
Note also that in the ordinary course of Internet activity, certain information may be sent from your browser to third parties such as advertising networks and analytics companies. EA has no control over the information sent from your browser to those networks or other third parties and recommends that you ensure that your browser settings prevent the disclosure of information you would not like to share.
If you post a video, image or photo on one of our sites for public view you should be aware that these may be viewed, collected, copied and/or used by other users without your consent. We are not responsible for the videos, images or photos that you choose to submit to EA's site. Please see our Terms of Service at terms.ea.com on this point and for other guidelines about posting content on our websites.
but just because they warn us that our content may be used by others, it does not mean they are giving people permission to do it. it means they are not taking responsibility for it.
sure twitter has retweeting as a function, but on the other hand, if somebody takes a video you've made on youtube and reposts it on their own youtube account, even if they let it be known who the original creator was, youtube makes it accessible for the creator to ask that the video be removed.
there is a whole lot of gray area on the web still, particularly when it comes to fair use and it's definition, and as much as i understand people wanting to preserve their OWN content here, it would be nice if there were a mindful consideration for others not wanting their content reproduced elsewhere. there seems to be an assumption that everyone is ok with the whole thing getting archived over, and i'm honestly not comfortable with that mindset. if you're going through the trouble of asking people who wants their account preserved, perhaps it would be fair to not transfer the content of those expressly do not want their account and content preserved.
