All those games are available as both a Download, and as a Disk here in Europe.
I think the games you cited are both in discs and download because the two versions was released in different moments, wipeout HD it was a dlc only when it was released the first time, after some months they released also the disc version. The rule says they cannot be released at the same time but there is no rule to prohibit BioWare for example to release first the dlc and after some time also the disc. That could be an interesting option that should permit the ones who lacks a decent high speed connection and won't buy the dlc version to wait some time and purchase the disc version directly.
The problem I think is that SCEE in this rule should also put time specifications rules , i.e.g. : "if the content is released through dlc/retail it must pass X days/weeks/months before a retail/dlc version can be released".
It could be useful to read the full SCEE rule and to have a response from BioWare if they intend to release also a disc version of the game when they can do it and personally I think they should do this because they will have earnings also from the people who cannot download Awakening in acceptable times or people that simply prefers to have a disc , for example for the valid reasons told by GulfWarVet , zy1054 and from other users in this topic, and also because (I don't know if someone else already told it) if some time in the future PSN decides to remove awakening from their store, and suppose you had a problem with your PS3 HD and have no working backup, you won't be able to download it again also if you paid 40 $ or 40 € ( yes another shame is that also if 1 € = 1.5 $ we have to pay it 40 € ) and this is kind of unacceptable.
