i saw where it said do you want to retrieve your previous saved game settings,which i was at level 38 it said.So what i'm asking is do you still start at level 1 again,because it seems i'm starting out at the beginning levels,so you don't start at your previous saved level?

You get bonuses for importing a saved game. The higher your level the more bonuses you get. But no, you are not going to start out at level 38. I think after I finished the first mission I was at level 4. I imported a level 50 character.
